Welcome to SparkNet. These Terms and Conditions (“Terms”) govern your use of the services, software, and website provided by Hostispeed (referred to as “The Company,” “We,” or “Us”).
By signing up for an account or using any Hostispeed services, you agree to be bound by these Terms. If you do not agree, you must immediately cease all use of our services.
1. Service Provision
SparkNet provides web hosting, domain registration, and related technical services. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.
2. Account Responsibilities
Accuracy: You must provide accurate and current information during registration.
Security: You are solely responsible for maintaining the confidentiality of your account credentials. All activities occurring under your account are your responsibility.
Eligibility: You must be at least 18 years old or have legal parental consent to use our services.
3. Acceptable Use Policy (AUP)
You agree NOT to use SparkNet services for:
Illegal Activities: Hosting or distributing copyrighted material without permission, child pornography, or any content that violates Indian or International law.
Spamming: Sending unsolicited bulk emails or maintaining open mail relays.
System Abuse: Attempting to circumvent server security, executing “Denial of Service” (DoS) attacks, or using excessive system resources (CPU/RAM) that impact other users on shared servers.
Malware: Hosting or distributing viruses, trojans, or phishing content.
4. Billing and Payments
Subscriptions: Services are billed on a recurring basis (monthly, quarterly, or annually).
Renewals: Accounts will automatically renew unless a cancellation request is submitted via the client area.
Non-Payment: Failure to pay invoices on time may lead to immediate service suspension and eventual termination/data deletion.
Price Changes: SparkNet reserves the right to change service pricing with a 30-day notice.
5. Uptime and Backups
Uptime: While we strive for 99.9% uptime, we do not guarantee uninterrupted service. Maintenance windows will be communicated in advance when possible.
Backups: Unless specifically included in your plan, data backups are the sole responsibility of the User. SparkNet is not liable for data loss due to hardware failure, software bugs, or user error. We strongly recommend maintaining off-site backups.
6. Domain Registration
Domain names are registered through third-party registrars. By registering a domain, you also agree to the terms provided by ICANN and the relevant registry. Domain renewals are the user’s responsibility; expired domains may be lost to the public market.
7. Limitation of Liability
To the maximum extent permitted by law, SparkNet shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business reputation, arising from the use or inability to use our servers or services.
8. Termination
We reserve the right to terminate your account immediately and without notice for any breach of these Terms, specifically the Acceptable Use Policy. Upon termination, all data hosted on our servers may be deleted permanently.
9. Governing Law
These Terms are governed by the laws of India. Any disputes shall be settled in the courts of the jurisdiction where the company is registered.
